Welcome to Soulfully Aligned (ABN 34 705 152 028), including Soulfully Aligned by Kristy, Kristy Colakidis, and all names and representations used by Kristy Colakidis ("Company," "we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of our website located at https://www.soulfullyaligned.com.au and all related Services including spiritual readings, soul-led coaching, intuitive development programs, events, workshops, crystal products, digital content, and all other services and products offered by Soulfully Aligned (collectively, the "Services").

By accessing or using any of our Services — whether online, in person, or through any digital platform — you ("Client," "you," "your") confirm that you have read, understood, and unconditionally agree to be bound by these Terms in their entirety, together with our Privacy Policy and any other policies published on this website.

If you do not agree to these Terms, you must cease using our Services immediately.

2. Eligibility

By using our Services, you confirm that:

• You are at least 18 years of age, or you have obtained verifiable parental or guardian consent to use our Services.
• You have the legal capacity to enter into a binding agreement.
• Your use of the Services is not prohibited by any applicable law in your jurisdiction.

Spiritual, Psychic & Mediumship Services

Soulfully Aligned offers psychic medium readings, mediumship sessions, spiritual guidance, oracle card readings, intuitive development, crystal healing, and related spiritual services. You acknowledge and agree to the following:

• Spiritual readings and mediumship sessions are not an exact science. Results, messages, and outcomes cannot be guaranteed. No specific outcome, result, or spirit connection is promised.
• All interpretations provided during sessions reflect Kristy's intuitive perception at the time of the session and may not be accurate for all individuals or circumstances.
• You are solely responsible for how you interpret, apply, or act upon any information received during a session.
• If you are experiencing a mental health crisis, medical emergency, or require professional support, you are strongly encouraged to seek qualified professional assistance before, during, or instead of using our spiritual Services.
• Soulfully Aligned is not a crisis or emergency service and does not provide mental health, medical, legal, or financial services.

Soul-Led Coaching

Soul-led coaching services offered through Soulfully Aligned are personal development and spiritual coaching services. They are not psychotherapy, counselling, or mental health treatment. Kristy Colakidis is not a licensed therapist, psychologist, or medical professional.

Coaching is a collaborative process designed to support your personal growth, clarity, and alignment. Results experienced through coaching vary between individuals and are dependent on your own commitment, effort, and readiness. No specific outcome is guaranteed.

Educational Programs & Digital Products

All digital programs, courses, workshops, and educational content are provided for personal development and informational purposes only. Results will vary between participants. Soulfully Aligned does not guarantee that participation in any program will result in any specific personal, professional, financial, or spiritual outcome.

Crystal & Mineral Products

Crystals and minerals sold through our website may contain natural elements, chemical compounds, or trace minerals that could be unsafe if handled improperly. By purchasing crystals or minerals from us, you agree that:

• You assume full liability for the use, handling, storage, and disposal of any crystals or minerals purchased.
• You understand that certain minerals may be toxic or hazardous if not handled correctly, ingested, or used inappropriately.
• Soulfully Aligned is not liable for any injuries, damages, adverse effects, or harm resulting from the use, handling, ingestion, or exposure to purchased crystals or minerals.
• Crystal healing is a complementary wellness practice and is not a substitute for medical treatment.

4. Right to Refuse Service

Soulfully Aligned and Kristy Colakidis reserve the absolute right, in our sole and unfettered discretion, to refuse, cancel, suspend, or terminate the provision of Services to any person at any time, for any reason, including but not limited to:

• Behaviour that is abusive, threatening, harassing, disrespectful, or offensive toward Kristy Colakidis or any associated person.
• Conduct that we reasonably believe poses a risk to the safety, wellbeing, or integrity of our business, staff, or other clients.
• Breach of any provision of these Terms.
• Fraudulent, deceptive, or unlawful conduct.
• Circumstances where we believe providing the Service would not be in the best interests of the client, including where a client appears to be in acute mental health distress without appropriate professional support.
• Any other circumstance at our sole discretion.

Our right to refuse service applies equally to in-person and online services, domestic and international clients, and is exercised without any obligation to provide a reason. This right is in addition to, and does not limit, any other rights or remedies available to us under these Terms or applicable law.

5. Bookings, Payments & Refunds

Bookings

All bookings are confirmed upon receipt of full payment unless otherwise agreed in writing. By booking a session, program, or event, you agree to these Terms in full.

We reserve the right to reschedule or cancel bookings in circumstances beyond our reasonable control, including illness, emergency, technical failure, or force majeure. In such circumstances, we will offer a rescheduled appointment or a full refund at our discretion.

Payments

• Payments are processed through secure third-party payment processors including Stripe and PayPal. We do not store your full payment card details.
• All prices are listed in Australian Dollars (AUD) unless otherwise stated.
• International clients are responsible for any currency conversion fees, bank charges, or taxes applicable in their jurisdiction.
• Payment plans, where offered, are subject to a separate payment plan agreement. Failure to make scheduled payments may result in suspension of access to Services without refund of amounts already paid.

Refunds

• Readings and coaching sessions: Due to the personal and time-limited nature of these Services, all completed sessions are non-refundable.
• Cancellations with more than 24 hours notice: May be eligible for a credit toward a future session at our discretion.
• Cancellations with less than 24 hours notice or no-shows: Are non-refundable and non-transferable.
• Digital products and programs: Are non-refundable once access has been provided, except where required by Australian Consumer Law.
• Physical products (crystals): Refund requests must be submitted within 14 days of delivery. Items must be returned in original condition. Return postage is at the buyer's expense. We do not accept returns on change-of-mind purchases.
• Events and workshops: Refund policies for specific events will be stated at the time of purchase and may vary.

6. Digital Platforms, AI Technologies & Third-Party Services

Video Conferencing & Digital Delivery

Many of our Services are delivered via digital platforms including Zoom and other video conferencing or communication tools. By booking and attending a digital session, you acknowledge and agree that:

• These platforms operate independently of Soulfully Aligned and are governed by their own terms of service and privacy policies.
• Soulfully Aligned has no control over the data practices, recording features, or AI-powered tools employed by these platforms.
• Technical difficulties, interruptions, or quality issues arising from third-party platforms do not entitle you to a refund, except at our sole discretion.

Artificial Intelligence & Automated Technologies

The digital technology landscape is evolving at an unprecedented pace. Third-party platforms used to deliver our Services — including video conferencing, scheduling, customer relationship management, email, and social media platforms — may now or in the future utilise artificial intelligence (AI) powered features including automated transcription, note-taking, recording, sentiment analysis, content moderation, and data processing.

Social Media Platforms

Soulfully Aligned and Kristy Colakidis maintain a presence on social media platforms including but not limited to Instagram, Facebook, and TikTok. You acknowledge and agree that:

• All social media platforms operate independently of Soulfully Aligned and are governed by their own terms, community guidelines, and privacy policies.
• Soulfully Aligned is not responsible for and expressly disclaims all liability for any content, interactions, data practices, algorithmic decisions, account restrictions, suspensions, content removals, or any other action taken by any social media platform.
• Any interaction you have with Soulfully Aligned through a social media platform is subject to that platform's terms and is at your own risk.
• Soulfully Aligned is not liable for any loss, damage, harm, reputational impact, or other consequence arising from the actions, policies, algorithms, AI tools, or decisions of any social media platform.
• Social media platforms may use AI to process, analyse, moderate, or otherwise handle content posted by or about Soulfully Aligned. We accept no liability for any such processing.
• Soulfully Aligned reserves the right to moderate, remove, or report any content on our social media channels that we deem harmful, offensive, inappropriate, or in violation of platform guidelines, without notice and without liability.

Evolving Technology & Future Developments

Given the rapidly evolving nature of digital technology, artificial intelligence, cybersecurity threats, and global technological developments, it is not possible to anticipate or address every technological circumstance that may arise. Soulfully Aligned will use reasonable endeavours to stay informed of and adapt to technological changes that affect our Services.

7. Client Responsibilities & Code of Conduct

By engaging with our Services, you agree to:

• Engage with all Services in good faith, with an open mind, and with respect for the nature of the Services offered.
• Treat Kristy Colakidis and all associated staff and community members with dignity and respect at all times.
• Not record, photograph, screenshot, or capture any session or content without prior written consent from Soulfully Aligned.
• Not share, distribute, publish, or reproduce session content, readings, or coaching conversations — in whole or in part — without prior written consent.
• Not use our Services for any unlawful purpose or in a way that could cause harm to yourself, others, or to Soulfully Aligned.
• Provide accurate and truthful information in all dealings with us.
• Take full and sole responsibility for any decisions, actions, or outcomes that arise from your engagement with our Services.
• Seek appropriate professional support (medical, legal, financial, psychological) for any matter that falls outside the scope of spiritual guidance and coaching.

8. Intellectual Property

All content on this website and within our Services — including but not limited to text, graphics, logos, images, photographs, videos, audio, course materials, program content, digital products, brand names, trademarks, and software — is owned by or licensed to Soulfully Aligned and Kristy Colakidis and is protected by Australian and international intellectual property laws.

• You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, transmit, or commercially exploit any of our content without our prior written permission.
• Program and course materials are licensed to you for personal use only. You may not share, resell, or distribute any program materials.
• The WOO framework, methodology, and associated branding are the intellectual property of Kristy Colakidis and Soulfully Aligned. Unauthorised use is strictly prohibited.
• Any testimonials, reviews, or content you submit to us may be used by Soulfully Aligned for marketing and promotional purposes, with your identifying information used only with your consent.

Infringement of our intellectual property rights may result in legal action. We actively monitor unauthorised use of our content and brand.

9. Limitation of Liability

To the maximum extent permitted by applicable law — including the Australian Consumer Law, the Competition and Consumer Act 2010 (Cth), and all applicable state, national, and international legislation — Soulfully Aligned and Kristy Colakidis shall not be liable for any:

• Direct, indirect, incidental, special, consequential, punitive, or exemplary damages of any kind.
• Loss of profit, revenue, data, goodwill, opportunity, or business.
• Personal injury, emotional distress, or psychological harm.
• Decisions made, actions taken, or outcomes experienced as a result of or in connection with any reading, coaching session, program, event, or other Service.
• Technical failures, interruptions, delays, or errors on our website or any third-party platform.
• Acts or omissions of third-party service providers, platforms, payment processors, or any other third party.
• Unauthorised access to or alteration of your data, whether by third parties or by circumstances beyond our reasonable control.
• Any event of force majeure including natural disasters, pandemics, acts of government, cyber attacks, technological failures, or any other event beyond our reasonable control.

This limitation of liability applies to the fullest extent permitted by law in all jurisdictions, including Australia and internationally. Nothing in these Terms is intended to exclude liability that cannot lawfully be excluded under applicable consumer protection legislation.

10. Indemnification

You agree to fully indemnify, defend, and hold harmless Soulfully Aligned, Kristy Colakidis, and their respective officers, employees, contractors, agents, affiliates, and successors from and against any and all claims, demands, actions, losses, liabilities, damages, costs, expenses (including reasonable legal fees), and penalties arising out of or in connection with:

• Harass, intimidate, threaten, or engage in inappropriate conduct toward Kristy Colakidis, staff, or other clients.

• Use our Services for competitive intelligence or to develop competing services.
• Violate any applicable local, state, national, or international law or regulation.

Violation of these prohibitions may result in immediate termination of access, reporting to law enforcement, and legal action to recover damages.

Any testimonials, case studies, or results shared on our website or social media represent individual experiences and outcomes. They are not typical and are not a guarantee of the same or similar results for any other person.

By submitting a testimonial, review, or feedback to Soulfully Aligned, you grant us a non-exclusive, royalty-free, perpetual licence to use, reproduce, edit, and publish that content in connection with our marketing and promotional activities, across all media and platforms, unless you specifically request otherwise in writing.

• Natural disasters, floods, fire, earthquake, or extreme weather events.
• Pandemic, epidemic, or public health emergency.
• Acts of government, war, terrorism, or civil unrest.
• Power outages, internet failures, or technical infrastructure failures.

• Illness or incapacity of Kristy Colakidis.
• Any other event beyond our reasonable control.

In the event of force majeure affecting the delivery of a booked session or event, we will make reasonable endeavours to reschedule. Where rescheduling is not possible, we will offer a credit or refund at our discretion.

17. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Victoria, Australia for the resolution of any dispute arising under or in connection with these Terms.

For international clients, to the extent that these Terms conflict with mandatory consumer protection laws in your jurisdiction, those mandatory protections shall apply. However, you agree that Australian law governs to the maximum extent permitted.

Dispute Resolution Process

Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute by contacting us at [email protected] and allowing us a reasonable opportunity (no less than 30 days) to respond and resolve the issue in good faith. Nothing in this clause prevents either party from seeking urgent injunctive or declaratory relief where necessary.
